PAWWWL, whut about the 8th amendment?

Harvey Updyke is made to pay for his crimes.

Harvey Updyke has pleaded guilty to poisoning Auburn’s famous Toomer’s Corner oak trees, reaching a deal with prosecution that will see him spend six months in jail and five years on supervised probation.

Updyke pleaded guilty to a charge of criminal damage of an agricultural facility, a Class-C felony in Alabama. In a statement announcing the plea deal, Lee County District Attorney Robbie Treese said, “We have a significant number of violent felonies awaiting trial in Lee County, and I could not in good conscience justify financing a three-week trial merely to arrive at no better a resolution.”

Updyke had previously pleaded not guilt by reason of mental disease or defect to charges of criminal mischief, desecration of a venerated object and unlawful damage to a crop facility charges. Other conditions of his plea deal include a 7 p.m. curfew, a ban from attending any collegiate sporting event, a ban from speaking to media, and a ban from setting foot on Auburn’s campus.  [Emphasis added.]

No Finebaum?  Forever?  Man, talk about your cruel and unusual punishment…

  1. I generally hate Aubums, but I have to admit I do have several I can call friends, but at least they have this one settled. Those Trade schoolers who stole the original UGA Bell still needs to return it and get punished. LOL

  2. Felony – can’t vote and can’t possess firearms. Probably a good thing in his case.

      Felonies cover everything from tax cheaters to shoplifters and mass murderers so I’m not sure how the gun thing should apply to Harv. It is what it is. My Dad was in SAC and was into sports cars, hunting dogs, and competitive shooting. We always had guns around our house and he is pretty adamant about that sort of thing. On the other hand my wife’s family is not. Her grandmother escaped from Italy, to Poland to Lithuania to England running from the mess Hitler created. Her family is not so pro guns and ammo. We tend to cater to my bride. But my sons know how to shoot.

      I thing Harv is a bit of a jerk …ok, a backwards ignorant jerk…. but I don’t think he should lose his right to vote.

      Alabama – Some persons convicted of a felony may apply to have their vote restored immediately upon completion of their full sentence. Those convicted of certain felony offenses such as murder, rape, incest, sexual crime against children, and treason are not eligible for re-enfranchisement.”

    The whole thing sounds a bit like lazy lawyering to me. No offense sirs and madams. In the end the Barners look silly substituting street lights for trees and rolling them. Georgia fans celebrate a victory by ringing a chapel bell. My youngest rang it after Donnan defeated uT in spite of Quincy. He was 10 at the time. I guess Harv spends 72 days in the local pokey after serving the initial 105. Do they run him through the system, where he is measured, deloused, weighed and evaluated before sending him to his place of confinement; where he will serve out the remainder of his term. There might….. just might be some barners at that Dx Center ……. don’t drop the soap Harv. You could get poisoned.

    “For purposes of this section, agricultural facility includes but is not limited to any land, building, structure, pond, impoundment, appurtenance, machinery, or equipment which is used for the commercial production or processing of crops, trees, livestock, animals, poultry, honeybees, honeybee products, livestock products, poultry products, or products which are used in commercial aquaculture.”

    Agricultural facilities…. not to be confused with Crop Facilities……..
    “Restitution costs have not yet been determined, DA Treese said. But he added that whatever the cost is to Updyke, it will be doubled under the Alabama Farm Animal, Crop and Research Facilities Protection Act.”

    Rolling Toomer’s Corner will continue at Auburn.

    Even if there are no oaks.

    The city will install three concrete poles and string wires between them to catch toilet paper fans traditionally rolled the oak trees with….wtf

    “It will be in the shape of a triangle, and we’ll span two wires between the poles, 3 or 4 inches apart, which will help the toilet paper catch on the wire,” Kevin Cowper, assistant Auburn city manager, told the Opelika News. “It’ll be at the height of the traffic lights, so it’ll be a pretty easy height for people to reach as well.”

    “They have MSU, Old Miss, UGA & Bama at home in conference. I doubt they get to roll the new clothesline for an SEC win this year”…
