        How in the world did they make a family violence charge if that’s all there is? The line about “neither party indicated they were in fear for their safety” would seem to be explicitly rule such a charge out, would it not? No report of physical contact, no fear of harm, therefore no assault charge therefore no family violence, right? This is a bad situation and I am pretty mad that the kid didn’t just leave for the night as he should have. It’s right and proper that he got dragged off to jail for being an idiot and for the damage to property charge. But fam violence? Seems to me that one is going to get dropped.

      If you go to a strangers house and did the same, I would guess it might disturbing the peace, destruction of property and criminal mischief.

    Obviously we will have to wait and see, what the family violence charge involved since it can encompass many things. I could be investigated and dropped. It may now be as bleak as it first appeared. This just came across 24/7. Sounds like this story got a whole lot more convoluted with the fact that UGAPD was involved. At the time of the incident they chose not to arrest anyone, but later go back and ask the judge for an arrest warrant? I felt that all the ones that Kirby sent packing in the past got what they deserved. This just does not pass the smell test on initial sniff.

      Just as an FYI, it’s not uncommon in a situation like this for the arrest not to take place on the scene and for officers to later consult with a DA or a judge to determine if warrants need to be issued and arrests made. If the parties can be separated for the night and officers believe there’s no more danger for the night, it’s not uncommon for the arrest not to be made that night if there’s no clear need for an arrest. My main question on it is how did they come around to the idea that they needed to make a FV charge if there was no physical violence and the parties said on the record they weren’t in fear of harm.
