Reader Alex sent me an email this week asking for a discussion on this:

Me, I watch that and see typical college kid dumbassery not worth a discussion, but Alex disagreeed with me:  “… I’d be interesting in seeing what the lawyers and wannabe lawyers think happens with the lawsuit”.

          Unca Got, after years of, umm, observing skreet fights I see so many things wrong in that clip that I’m appalled. It’s a typical post-adolescent brawl. I have younger friends practicing MMA and that is what is taught at their particular gym. Take ’em down and choke ’em out. It worked for those two in this instance because their opponents weren’t savage enough to rip their eye out and the brutes didn’t have buddies waiting to put the boots to their head. You never go to the ground. Those types generally travel in packs and you need to stay upright so you can beat feet if you have to.
          And what was that love tap left before the right punch to the face? “Hey dumbass, I’m fixing to hit you.” No need to advertise your intentions. Don’t know why he went to the head first anyway. Unless you have a Tyson-one-punch-knockout you need to debilitate that mook with a hard punch to the short ribs or, better yet, snap kick to the groin.
          Those bullies got what they deserved for sure. All in all it should be part of growing up if you’re gonna drink in bars and run your mouth. Lesson learned and no cops or lawyers need be involved. The real takeaway is all those fellows are fortunate. There are some of the boys that don’t take too kindly to being penned up with nowhere to run. They will inflict permanent damage and aren’t worried about jail time.
          Or so I read on the internet.

I think I’d need more facts to consider the legal implications but it seems unlikely a jury would have much sympathy for the young man who picked the fight even if he didn’t ‘throw the first punch.’ The ‘winner’ there might have some criminal liability but it’s tough to see a prosecutor bringing a case. But, I think you really need the story from everyone there to know more what’s going on.

    Jocko Willink had a surprising answer when asked a similar question on his podcast. He was asked what you should do when confronted by someone looking for a fight. Jacko, as some of you may be familiar with him, looks like one of the last people on Earth you’d ever want to mess with and is a trained MMA fighter. His previous years were spent as a Navy SEAL also.

    Anyway, he said that unless you must defend yourself and have no alternative, you should always look for and escape route and run away. He went on to say that, even if you can prove self-defense, there’s a good chance you’ll end up having to defend yourself in court and spend thousands of legal fees doing so… and that is even if you’re ultimately acquitted.

    More so, he gave examples of people who defended themselves and knocked the aggressor down, and they end up hitting their head on the sidewalk or concrete and died, thus leading to serious criminal charges. Literally people’s lives have been ruined by getting in fights they didn’t ask for was the key point.

    With all that said I don’t really have an opinion on the outcome of this but I suspect the two MMA brothers probably going to be shoveling out quite a bit of money in the end, along with probable criminal charges of some kind as well.

      Jones’ friend that got his head bashed into the wall at the end is lucky to not have a serious injury. Speaks to exactly what you’re talking about.

        Right. From my understanding knowing quite a few lawyers and people law enforcement who have dealt with this stuff, it’s not the punch itself that leads to big trouble, it’s the person falling down and hitting their head on a hard object (ground, wall, etc.) is what most often leads to serious and sometimes fatal injuries.

        if there’s two brothers were being actively attacked in the bathroom by the two football players, they almost certainly would escape any repercussions in the end. But merely them being told to get the f out of here while being lightly pushed is entirely different matter. again I’m not illegal expert so I have no clue how this ends up, nor do I care, but either way I would certainly not want to be in their shoes.

        As for the two football players, they have to live with embarrassment of them getting their ass kicked on video for the rest of their lives. So they too have suffered embarrassment and hopefully have learned a lesson from this. As always in this situation, there are no winners, only losers.

          Well, but if you read the article, Brown’s lawyer (and Brown himself) state that the video doesn’t show the whole event: Brown’s nose is clearly bloody at the start of the video, which they say was caused by Jones.

    Just seeing this for the first time. First thought was to Google Oklahoma stand your ground laws. Check. The MMA brothers may have been in less trouble just shooting and killing the football players.

    I can’t even tell who the MMA guys are and who the Oklahoma football player. Is the short guy that was bleeding from the nose and threw the first punch the football player? Because if so, it appears he did pretty well.

      Ok, I just looked up a picture of Jones and he is the tall guy that does the pushing. Yeah, he got his clock cleaned by the quick successive straights the MMA guy threw before going down for the grapple.

      If you get taken down to the ground like that you are in big trouble. Need to start biting and going for eyes at that point.

        Rule of thumb – acting aggressive towards someone who has cauliflower ear who smirks in the process almost assuredly will lead to your ass being kicked.

    The OU guy is their frigging HOLDER on place kicks. It’s not like he some terrifying LB or something. Hanging around some bigger dudes in the locker room puffed this guy up. The MMA guys readjusted his attitude (and eye socket).

    Looks like an altercation and maybe some punches preceded this stupidity. To the points made above re serious repercussions of a person hitting his head, the guy in the jean jacket was KO’d by hitting the wall – never moved again. This may not be over by a long shot. To the points above about fighting in bad places, I took shit and said excuse me a lot in bars because of that very issue. You never know what can come into play with a bad surface and lots of people.

      Me and you, Hunkering. Anybody remember Uncle Tom’s Tavern on Memorial Drive in Stone Mountain? Place was good for this type of activity most weekends. Saw Mollie Hatchet there before they were big. Fight started near the stage and before it was over, the band was involved.

    Fortunately for me, I learned at a very young age that I am not capable of keeping a level head in a physical altercation. Oddly enough, I learned that trying to play football. What always happened was that I would lose my head because I couldn’t control my anger. Maybe now that I’m 50 I would keep my wits about me but don’t expect to have to find out. The only punches I have ever thrown were in 7th grade when a kid tried to take my brown paper bagged lunch. I punched him about 4 times in the face and he just ran away.

    If I’m the judge, they all get thirty days of showing up every evening after work/school and cleaning the heads in the local jail house. After that, I’d have the folks that were egging it on and videoing it do the same for ten days.
    But I still can’t be mad at Pickens for using that GT player for a battering ram.
