However, there could be a snag. Marc Jacobs, the apparel company, beat Ohio State to the punch when it comes to that three-letter word. Its application for “THE” (as in THE BACKPACK MARC JACOBS) was approved by the U.S. Patent and Trademark Office in June, but that remains under review, according to the Jacobs application. Marc Jacobs would have priority in the trademark because of the filing date, according to Gerben.

No word yet on whether Georgia is considering pursuing a trademark for “AND” from Red and Black.

      And it is a truer representation. They are also widely linked to “obnoxious” and “pretentious” jerks. Regardless of accuracy I doubt they get those either, although both terms fit them well. But it is both “obnoxious and pretentious” to lay claim to THE most frequently used word in THE English language (but not surprising.)

    According to the USPTO: the legal definition of a trademark is any word, slogan, symbol, design, or combination of these things, that identifies the source of your goods and services and distinguishes them from the goods and services of another party. But the easiest way to think about it is this: a trademark is a brand for goods and services. How exactly does ‘the’ fit that definition?

    I suppose this might be a rant better suited for the playpen, but trademarks and patents have gotten way, way out of hand. They dominate our trade negotiations. We fork over billions in excessive fees. Bill Gates still receives billions for a patent from decades ago (for a product many people believe he stole). The sooner we cut the length of these trademarks and patents down to something like 7 years, the better off every man, woman, and child will be.
